Introduction:
1.1 These Terms and Conditions apply in whole to all individuals and entities who post on, use, interact with or simply visit the Pensions Barrister website (“the Site”) (www.pensionsbarrister.com). The Site is owned and controlled by Paul Newman KC, who is contactable at his Chambers address, Wilberforce Chambers, 8 New Square, Lincoln’s Inn, London WC2A 3QP or using the e-mail address info@pensionsbarrister.com.
1.2 By posting on/using/interacting with and/or visiting the Site, you agree to the applicability of these Terms and Conditions to the contract between yourself and Pensions Barrister. For this reason, it is important that you take your time to read this document carefully.
1.3 Please note that these Terms and Conditions are governed by, and construed in accordance with, the law of England and Wales. If you are accessing the Site from outside of the United Kingdom, as a user of the Site you are solely responsible for complying with all local laws and regulations.
1.4 For the purpose of these Terms and Conditions “Pensions Barrister” refers to Paul Newman KC and any other members of the editorial board of the Site individually and/or collectively.

Description
2.1 Paul Newman KC, the owner of Pensions Barrister website, is a self-employed Barrister who practices from Wilberforce Chambers in London. He has substantial knowledge and experience in litigation and advisory practice, with an emphasis on pensions, financial services and trusts.
2.2 The Site has been created with the intention of providing users with a space to post articles and questions, share pictures and interact with the educational resources that Pensions Barrister, in collaboration with other barristers and professionals, have produced. The Site, at present, is a place for educational resources.
2.3 Under no circumstance does the content on the Site constitute legal or financial advice. Please remember this when visiting the Site, as well as watching any of the videos, listening to any podcasts or reading any of the content.

Creating an account
3.1 You will need to create an account if you wish to post, inform or interact with any of the additional facilities on the Site. If you are only going to view information on the Site you do not need to create an account.

Acceptable Use
5.1 The Site must only be used in compliance with these Terms and Conditions. You must not use the Site in a manner that is unlawful or fraudulent.
5.2 You must not knowingly cause harm to the Site by uploading, sending or in any way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computer, hardware, software, or data of any kind.
5.3 You must not knowingly cause any harm to any other user of the Site.
5.4 You must not post anything that could be termed offensive and/or illegal.
5.5 Users must not ask for legal or financial advice from any of the users directly through the Site.
5.6 Users must not provide financial and legal advice through the Site.
5.7 You must make sure anything that you do post does not infringe anyone else’s intellectual property rights.
5.8 Users must not post any information or image that they know or should know is either false, inaccurate or misleading or can otherwise jeopardise the integrity of the Site.
5.9 Pensions Barrister reserves the right to remove any content it deems unacceptable at its sole discretion.

Consequently, Pensions Barrister neither assumes nor accepts any responsibility or liability for the content displayed on any third party sites.

Intellectual Property
7.1 All content on the Site, including copyright or trademark material or other intellectual property, belongs to Paul Newman KC. Such content is protected by Intellectual Property laws and regulations and may not be copied, reproduced or used in any way without express permission from Paul Newman KC.
7.2 Intellectual property on the Site may be reshared or used by others with the express consent of Paul Newman KC and must contain appropriate reference to the Site as its source.

Indemnity
8.1 As a user of the Site, you shall defend, indemnify and hold harmless Pensions Barrister against claims, actions or proceedings for losses, damages and costs, including court costs and reasonable legal fees, arising out of or in connection with your use of the Site.

9.1 Pensions Barrister does its best to ensure the safety, security and accessibility of the Site. However, Pensions Barrister cannot be held liable for any damages directly or indirectly resulting from the use of the Site.
9.2 Nothing in these Terms and Conditions seeks to exclude or limits Pension Barrister’s liability to the extent that it cannot lawfully be excluded or limited.
9.3 Although user’s posts are monitored, Pensions Barrister accepts no liability for any harm for any users reliance on information posted or other harm that might arise.

11.Changes to the Terms and Conditions
11.1 Paul Newman KC, as the owner may alter these Terms and Conditions at any time. If he decides to do so, any changes will become binding on all visitors on their first visit to the Site after the changes have been made.
11.2 All visitors are therefore advised to check this page and read Pensions Barrister’s Terms and Conditions upon every visit to the Site.

12.Data Protection, Privacy and Cookies
12.1 These Terms and Conditions have been drafted in line and in accordance with the UK Data Protection Act 2018 (“DPA’18”).
12.2 Use of the Site is governed by Pensions Barrister’s Privacy and Cookie Policy which can both be found here www.pensionsbarrister.com/privacy-policy and www.pensionsbarrister.com/cookie-policy. These policies are incorporated into these Terms and Conditions by this reference.

13.Severability
13.1 If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that/those provision(s) shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

14.Law and Jurisdiction
14.1 These Terms and Conditions, and the relationship between Pensions Barrister and users or visitors of the Site (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England and Wales.
14.2 Any disputes concerning these Terms and Conditions, the relationship between users, visitors and Pensions Barrister, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England and Wales.

15.1 Any complaints about information or discussions on the Site can be directed to info@pensionsbarrister.com. It is at the sole discretion of Paul Newman KC, as the Site owner, whether the information will be removed or amended.
